Introduction
Dear Customer,
These Terms and Conditions govern the conclusion of sales contracts via the above-mentioned website, the rules for the performance of such contracts including delivery, rights and obligations arising from applicable law, and the procedure for withdrawal from the contract and complaints.
The Terms and Conditions consist of four main parts:
- §§1–3 – general provisions;
- §§4–7 – the purchase process of Goods/Services;
- §§8–12 – provisions regarding defects in Goods/Services and the right of withdrawal;
- §13 – all remaining provisions.

Seller’s Address – whenever referred to in these Terms and Conditions, it means:

Customer – a natural person with full legal capacity, and in cases provided by law also a person with limited legal capacity, a legal entity, or an organizational unit without legal personality granted legal capacity by law, who has concluded or intends to conclude a sales contract.
Consumer – pursuant to Article 22¹ of the Polish Civil Code: a natural person performing a legal act with the Seller not directly related to their business or professional activity.
Sales Contract – a contract for the sale of a Product listed in the Online Store concluded between the Customer and the Seller via the Online Store.
Goods/Service – a Product, movable item purchased by the Customer via the Online Store.
Paragliding equipment – sold online and offline, shipped or collected in person.
Order – a declaration of intent made by the Customer via the Online Store specifying the type and quantity of Goods, payment method, delivery method, place of delivery, and Customer details.
Order Form – an electronic service available in the Online Store enabling the submission and processing of an Order.
Order Fulfillment Time – the time required to complete, pack, seal, and hand over the Order for delivery.
Business Day – Monday to Friday excluding public holidays.
Consumer Rights Act – the Polish Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014 item 827, as amended).
- 2 General Provisions
The Seller declares compliance with all required personal data protection regulations, including the Act of 10 May 2018 on Personal Data Protection and Regulation (EU) 2016/679 of 27 April 2016 (GDPR).
The Customer consents to the collection, storage, and processing of personal data solely for the purpose of fulfilling the Order. Detailed rules are set out in the Privacy Policy.
By placing an Order, the Customer confirms that they have read and accepted these Terms and Conditions. Acceptance is required to complete the Order. Conclusion of a sales contract entails an obligation to pay for the ordered Goods.
The data controller is Aeroplan Sp. z o.o., Wola Mielecka 577b, 39-300 Mielec, Poland.
Each person whose data is processed has the right to:
- access their data,
- rectify, update, or delete data,
- restrict processing,
- data portability,
- withdraw consent at any time,
- lodge a complaint with the Polish Data Protection Authority (UODO).
The Seller processes Orders within Poland and Europe, and to other countries upon prior agreement.
All Goods offered in the Store are legally introduced to the Polish market and comply with applicable law.
- 3 Terms of Service
The Online Store provides services electronically.
Placing an Order requires completing the online Order Form.
The service is provided free of charge but requires internet access.
Orders can be placed 24/7.
Providing personal data is voluntary but necessary to conclude the contract.
The Customer bears the cost of internet access according to their provider’s tariff.
- 4 Contract Terms
To conclude a valid Sales Contract, the Customer selects the Goods, specifies quantity and details, and provides necessary information via the Order Form.
Customer account registration is voluntary and free of charge.
After receiving the Order, the Seller sends an email confirmation. The contract is concluded upon receipt of this confirmation by the Customer.
The confirmation includes all essential contract details: type and quantity of Goods, total price (in PLN), delivery costs, and applied discounts.
- 5 Order Fulfillment
Orders are processed in the order received.
Processing time is counted from payment authorization.
Standard fulfillment time is 1–5 business days unless otherwise specified.
If fulfillment is not possible within the indicated time, the Seller will contact the Customer to agree on further steps.
- 6 Delivery
Delivery is made via courier or another mutually agreed method.
Goods may be delivered to the address indicated in the Order or collected in person.
Delivery costs are displayed during the ordering process.
Shipping cost within Poland: PLN 19.99 (gross).
- 7 Payment Methods
Payment may be made by:
- Bank transfer (account number provided in the Store),
- BLIK payment,
- Online bank transfer via Pay Now,
- Payment card (Visa, Visa Electron, Mastercard, Mastercard Electronic, Maestro) via Blue Media S.A.
- 8 Statutory Warranty (Liability for Defects)
The Seller is liable for defects identified within 2 years of delivery to the Consumer.
Complaints should be submitted by email or post to the Seller’s address.
The Seller responds within 14 calendar days. Failure to respond within this time means the complaint is deemed accepted.
- 9 Withdrawal from the Contract
A Consumer has the right to withdraw from a distance contract within 14 calendar days without giving a reason.
Withdrawal must be submitted in writing (email or post).
The Seller refunds all payments within 14 days of receiving the withdrawal notice.
The Consumer bears direct costs of returning the Goods.
The right of withdrawal does not apply in cases listed in Article 38 of the Consumer Rights Act (e.g., custom-made goods, sealed goods opened after delivery for hygiene reasons, fully performed services with consent, etc.).
- 10 Complaint Procedure
A complaint should include Customer details, order number (if available), and a description of the defect.
The Seller responds within 14 days.
If no response is given within this period, the complaint is deemed accepted.
- 11 Liability
The Customer is prohibited from:
- posting third-party personal data without consent,
- publishing unlawful, offensive, or infringing content,
- sending spam,
- violating good customs or applicable law.
The Seller reserves the right to remove content violating these Terms or applicable law.
- 12 Out-of-Court Dispute Resolution
Consumers may use out-of-court complaint and claim procedures, including mediation before the Trade Inspection Authority or the Consumer Arbitration Court.

Use of out-of-court procedures is voluntary.
- 14 Warranty
A 12-month commercial warranty is granted from the date of purchase.
The warranty does not cover:
- transport damage,
- user-caused damage,
- improper use,
- unauthorized repairs or modifications.
The Customer bears shipping costs when sending Goods under warranty.
Final Provisions
Polish law applies, in particular:
- Polish Civil Code,
- Consumer Rights Act (30 May 2014),
- Act on Providing Services by Electronic Means,
- Industrial Property Law,
- Copyright and Related Rights Act.
The Seller may amend the Terms for valid reasons (e.g., changes in law, payment methods, delivery methods).
Amendments do not affect Orders already placed.
The Terms enter into force on 28 May 2019.
Copyright Notice
All copyrights to this Sales Terms template belong to a Law Firm that granted the Store a non-exclusive, non-transferable license for use. Copying or distributing this template without consent is prohibited and may result in civil and criminal liability.
